How to Get Your Security Deposit Back in Delhi NCR (2026)
What landlords can and cannot deduct, what the law says in Noida, Ghaziabad, Delhi and Gurgaon, and a step-by-step plan to get your full deposit back on time.

In this article
The security deposit is usually the biggest cheque you write when you rent a flat in Delhi NCR, and getting it back is where many tenancies end badly. The good news: most disputes are avoidable if you document a few things at move-in and handle move-out properly. This guide covers what the law says in each part of NCR, what a landlord can and cannot deduct, and what to do if your money is held back.
How much deposit is normal in Delhi NCR?
Two to three months' rent is common across NCR. The rules depend on where the flat is:
- Noida, Greater Noida and Ghaziabad (Uttar Pradesh): the state's 2021 tenancy law caps the deposit at two months' rent for homes.
- Delhi: no fixed cap for most private tenancies. The amount is whatever your agreement says.
- Gurgaon and Faridabad (Haryana): no fixed cap for most private tenancies either. The agreement decides.
The central Model Tenancy Act, 2021 suggests a two-month cap, but it only applies where a state adopts it as law. Our rent agreement guide explains the rules state by state.
When should the deposit come back?
In Uttar Pradesh, the law says the deposit is refunded on the date the landlord takes back vacant possession of the flat, after deducting anything you owe. In Delhi and Haryana, the refund date is whatever your agreement says, so make sure it says one. Ask for a clause that the deposit will be refunded within 7 to 15 days of handover.
What a landlord can and cannot deduct
Fair deductions usually include:
- Rent you have not paid.
- Unpaid electricity, water or maintenance bills that were your responsibility.
- Damage beyond normal wear and tear, such as a broken window or a damaged appliance.
- Missing keys or items listed in the signed inventory.
- Charges your agreement clearly lists, such as deep cleaning or repainting.
Deductions you can push back on:
- Normal wear and tear: faded paint, minor scuffs, ageing fittings.
- Repairs to things that failed from age, like an old geyser.
- Vague "maintenance" or "repair" charges with no bill and nothing in the agreement.
- Holding the whole deposit as a penalty when the agreement says nothing about it.
Step 1: at move-in
- Get it in writing. Your agreement should state the deposit amount, the refund timeline and what can be deducted.
- Pay by bank transfer or UPI, never cash, and keep the receipt.
- Make an inventory. List furniture, appliances and fittings with their condition, and have both of you sign it.
- Take dated photos and a video of every room, including existing damage, and email them to the landlord the same day.
- Note meter readings for electricity and water.
Step 2: while you live there
- Pay rent by bank transfer and keep receipts.
- Report repairs in writing (WhatsApp or email) with photos.
- Ask before making changes like drilling walls or painting, and keep the owner's reply.
Step 3: before you move out
- Give notice in writing as your agreement requires, often one month.
- Keep paying rent. Only adjust the last month's rent against the deposit if the landlord agrees in writing.
- Clear every bill using final meter readings, and keep the receipts.
- Clean the flat and fix anything you damaged.
- Do a joint inspection with the landlord a few days before you leave, using your move-in inventory and photos.
- Hand over the keys against a written acknowledgement, and take exit photos.
- Ask for a written settlement showing any deductions and the refund amount, and share your bank details.
A worked example
Say your rent is ₹25,000 and your deposit is ₹50,000. At move-out you owe a final electricity bill of ₹1,800 and you broke a window latch that cost ₹600 to replace. A fair refund is ₹47,600. If the landlord also deducts ₹10,000 for "repainting" that your agreement never mentions, that is a deduction you can challenge.
If the landlord will not refund
- Send a written reminder with the handover date, the amount due and your bank details.
- Send a legal notice through a lawyer if the reminder is ignored.
- In Uttar Pradesh (Noida, Greater Noida, Ghaziabad), tenancy disputes under the 2021 law go to the Rent Authority, an officer appointed by the district collector.
- In Delhi and Haryana, the usual routes are mediation or a civil suit for recovery.
- If a refund cheque bounces, you can send a demand notice within 30 days; if the landlord does not pay within 15 days of receiving it, you can file a cheque-bounce case.
Keep your agreement, receipts, photos and messages together; they decide most disputes. This guide is general information, not legal advice.

FAQs
Questions renters ask.
How long does a landlord have to return the security deposit?
In Uttar Pradesh, the deposit should be refunded when the landlord takes back vacant possession, after deducting anything you owe. In Delhi and Haryana, it is whatever your agreement says, so ask for a refund within 7 to 15 days of handover in writing.
Can my landlord deduct painting charges?
Only if your agreement says so, or if you caused damage beyond normal wear and tear. Paint that has simply aged over your stay is normal wear and tear.
Can I adjust my deposit against the last month's rent?
Only if the landlord agrees in writing. Otherwise you may be treated as not having paid rent, which gives the landlord a reason to deduct more.
What can I do if my landlord in Noida won't return my deposit?
Send a written reminder, then a legal notice. Tenancy disputes under Uttar Pradesh's 2021 law go to the Rent Authority, an officer appointed by the district collector.
Is there a security deposit with Ease Your Lease?
One month's rent, refundable. You book online with 20% of one month's rent, pay the rest of the first month and the deposit before you move in, and there is zero brokerage.
